How the calculation works

For each full year of service you get half a week's pay for years worked under 22, one week's pay for years worked between 22 and 40, and one and a half weeks' pay for years worked from 41 onwards. Only the last 20 years count, and a week's pay is capped at £719.00 for this purpose. These are the rules for England and Wales.

The statutory figure is only part of the picture. If you are offered a settlement agreement, the negotiable ex gratia payment sits on top, along with notice, holiday and any bonus. See our settlement agreement calculator for that side of it.

Common questions

Who qualifies for statutory redundancy pay?

You normally need two years' continuous service with the same employer and to be dismissed by reason of redundancy. Some roles, such as certain short fixed-term contracts, are treated differently.

Is statutory redundancy pay taxed?

Genuine redundancy payments are tax free up to £30,000. Notice pay, holiday pay and bonuses are taxed as earnings, so a package can be part tax free and part taxable.

Can I get more than the statutory amount?

Often, yes. Many employers run enhanced schemes, and settlement agreements usually include an extra ex gratia payment on top. The statutory figure is a floor, not a ceiling.
